As the raiding party made its way toward the still Officer Simmons was shot in the back from ambush. The shooters were able to flee the scene as the other officers sought cover and retreated to call for assistance. Several members of one family were arrested and charged with his murder. Two were convicted and sentenced to life, while three others were acquitted. Officer Simmons had given up a life of farming to become a prohibition officer after his son was given illegal liquor by moonshiners.4 He was buried at Blue Jay Cemetery, Raleigh Co., West Virginia.3 He was born on March 1, 1886 at Marie, Summers Co., West Virginia.1 He married Martha Ann Light, daughter of James Light and Sarah Olive Clower, on April 8, 1914 at Summers Co., West Virginia.5 Gustavus James "Gus" Simmons died on July 11, 1927 at Pineville, Wyoming Co., West Virginia, at age 41; Shot to death in a homicide.2 He Gus Simmons was 41 years of age and was born and raised in Summers county in the Jumping Branch district where he resided most of his life, leaving there a few years ago, and at the time of his death he was living in Beckley. He was the son of Mr. and Mrs. Joseph Simmons and followed the occupation of farming before entering the prohibition service several years ago. He is survived by hts wife and five children, of Beckley, his mother, Mrs. Mary M. Simmons of this city, and six sisters; Mrs. J. T. A resident of this city, who knew Simmons intimately said that Simmons had told him the story on more than one occasion of how he cams to take up the prohibition enforcement work. According to the story told by Simmons, moonshiners around Jumping Branch, were taking his oldest son out with them and on several occasions got him drunk. They were warned by Simmons to not bother his boy, but they seemed to pay no attention to him and he joined the prohibition forces in order to combat the moonshiners, and to get revenge on them. on July 12, 1927.6

Jonathon "John" Poff was born circa 1802 at Montgomery (now Floyd) Co., Virginia.2,6,7 He married Sarah Montle on August 31, 1820 at Preble Co., Ohio.3,4,9,5 Jonathon "John" Poff married Ruth Wilson, daughter of Peter Wilson and Rhoda "Chloe" Hathaway, on May 23, 1826 at Montgomery Co., Virginia.2,10,8,6 Jonathon "John" Poff died in 1842 at Giles Co., Virginia.11,6,7 He The murder of John Poff by David Lucas of Giles Co. From an article from a Richmond newspaper on this Lucas family. They were an extremely cruel bunch. The article also tells of murders committed by brothers of David Lucas. This is what it says about John Poff. This was a letter written to someone at the newspaper who had recently visited one of the Lucas boys in the penitentiary. The paper was dated July 13, 1842. "Lucas' last crime, and for the perpetration of which the world has been freed from such a monster, was the murder of John Poff, a poor laborer, who had been working at the salt works on Kanawha a few months, and who, with the proceeds of his labor in a wallet, was traveling on foot and alone to his family and home in the county of Floyd. Lucas fell in with him on the highway, and as it was late in the evening, enticed him to go home with him, and he said he could entertain him for the night as well as any one. In an evil moment poor Poff consented, and soon after met his fate. "Dave" killed him within less than five hundred yards of his cabin, and so obscure is Lucas" residence, that the murdered man lay nearly a week above ground without discovery, and what is certainly a very strange infatuation on the part of the murderer, apparently, no pains or care was taken to conceal the foul deed. This wretched criminal was apprehended, tried, and found guilty of this murder by the jury in fifteen minutes from their retirement from the court room. There were seventeen witnesses on behalf of the Commonwealth: the criminal had no witness and refused to employ counsel. The court, of course, assigned him counsel but his case was so plain and flagrant that the learned counsel (I presume) thought it unnecessary to make any defence, and submitted it to the jury without argument. Sentence of death was therefore pronounced upon him, and in accordance, he was hung on Friday, the 24th of June, at Giles Court House, the day you saw his brother in the Penitentiary. The spectators, male and female, black and white, would number perhaps 5000. The wretched man died as he had lived, reckless and without any outward sign of compunction ---- made no particular confession when under the gallows, on the contrary, made use of profane language when in this awful situation, in response to something said to him by some of the attending clergy, and finally made an attempt to bite the sheriff's ear whilst he was adjusting the rope around his neck. So he lived, and thus died David Lucas, the wretched murderer. The Hon. Judge Brown's address to Lucas on passing his sentence, has been published in the Richmond Whig. If you have not seen it, it is well worthy of reading." This John Poff could very well have been the John that was married to Ruth Wilson. In 1850 Ruth was living with Harvey Wilson. The other John Poff living at that time was marr. to Mary Hartsough, living in Franklin Co. and didn't die until 1845. on July 13, 1842.11
