State Police Capt. John W. Burrow said Yates was being taken to Floyd in Phipps' patrol car after being arrested on suspicion of drunken driving at Locust Grove. The prisoner apparently tried to escape, Burrow said, and Phipps stopped the car to handcuff him. During the struggle the trooper was injured on the head and neck and Yates was fatally wounded with one shot. Phipps was released after being treated at Roanoke Memorial Hospital. on May 31, 1965.4

Grandchildren Amanda (Jeremy) Cluxton, Tyler (Sarah) Wood, Abbey Yates (Phillip Burnett), Taylor Wood (Calvin Weddle), Presley Yates, Sierra Muncy, Hannah (Brent) Thompson, Olivia Yates, Aiden Yates and Karly Yates along with beloved great grandson Gentry. She is also survived by brother Frank Steele (Pam) and many special nieces, nephews, friends and family. Helen is survived by her sister, Laura Eugenia Yates Link; daughter, Anita Kaye Giles; granddaughters, Dana Marie Rowland (Buddy), Jessica Lynn Perdue (Logan); four great grandchildren, Zoe Lynn Rowland, Owen Michael Rowland, Rieker Oakley Perdue, and Xander Rhett Perdue.
