John "of Dan River" Yates III was buried at Yates Cemetery, beside of Yates Tavern, 1/4 mile south of Gretna, Pittsylvania Co., Virginia.3 He Appears in the list of titheables of Pittsylvania Co. in 1753. The marriage could have occurred in 1737. From "History of Pittsylvania County" by Maud Carter Clement "On Thursday, 1 June 1758, John Yates was among several residents of Halifax County, Virginia (now Pittsylvania) who gave depositions telling of attacks and robberies by Indians. It reads: 'John Yates (this could also be the son, John Yates) being sworn deposed, that he in company with one Philip Preston were rideing along the road together not having heard anything about the Indians, or suspecting anything about them. He heard a Gun fired close behind him, and turning about discovered three Indians close at his Heels, That they could have made their Escape, But on the Indians calling out Cherrockees and holding out their hands in token of friendship, and fearing to be fired at should they attempt to Escape, they stopped. The Indians came up to them and Shook hands, and then instantly pulled them off their Horses, beat them with Sticks, Stripped them naked, took all they had from them, pointed their Guns at them, and Ordered them to run which Order they instantly Obeyed.'" John is listed in the 1767 tithables with his son John and slaves Bob and Cate taken by John Wilson. All of John's household furniture and a negro woman called 'Little Cate' was to be divided among his children at the discretion of his wife at or before her death. Household help listed in this will are being posted here for the benefit of those looking for their African-American ancestors. John's will was signed on October 4th, 1777. Information on ownership of the tavern was provided by Donald Panther-Yates which he obtained from the Historic Register. Also the info regarding the birthplace of John. Notes on John Yates, III John Yates left his will in Pittsylvania County in 1778. He is known in family history circles as John Yates of Dan River. His will was dated October 24, 1777 and was probated April 23, 1778. He owned a tavern near Gretna, Virginia (on Rte. 29 near Chatham) that is on the Historic Site register. The Blue Ridge Park created in this century took part of the Yates land. There is a Yates reunion in Patrick Springs. They were all Primitive Baptists. Could be the John Yates who received a grant of 356 acres in Virginia in 1735 (Bishop Meade) and the John Yeates who received 204 acres in Brunswick County, July 26, 1747 (No. 28, p. 89). A John Yates also received 348 acres in Pittsylvania County, March 1, 1773; alternatively this could have been his son, John L. Yates. From Donald Panther-Yates web site. I, John Yates of the county of Pittsylvania and colony of Virginia, being sick and weak in body but of sound and perfect memory, I do first give my soul to God and my body to be buried in a decent manner at the discretion of my executors here after named in, amen. I dispose of my worldly estate as follows to wit: First I leave unto my beloved wife Elizabeth Yates during her life all my real and personal estate and after her decease the negroes and land to be divided as follows: First, I give unto my eldest son John Yates and his heirs a part of my land where John Gibson lived begining at my corner tree on Hughs Creek and taking the full width of the land up Dan River to a branch at the corner end of my plantation and a negro man named Bob. 2 item: I give unto my son George Yates and his heirs another part of the land where I now dwell begining where my son John's land ends and running with the said branch to the backline, likewise a part of a survey last made adjoining where I now dwell and edge leading up to Thomas Watts line. But the land over the river is to end and upwards to a branch that runs below Gibsons plantation and with the said branch to the back line and a negro man named Sam and all my smiths tools. 3 item: I give unto my son Elijah Yates and his heirs forever all the remainder of the tract of land whereon I now dwell begining at the branch below Gibsons and running up the river and including all the remainder of the two tracts whereon I now dwell and a negro boy named Peter and a negro girl named Judith. 4 item: I give unto my daughter Ann Gibson and her heirs one negro girl named Esther. Likewise I give unto her heirs forever all the remainder of a tract of land whereon she now dwells adjoing a made line between her and the plantation where Thomas Watts lived, allowing one hundred acres to the plantation where Thomas Watts lived. I give unto my son George Yeates and his heirs a negroe girl named Silvy and her increase. Item third. I give unto my son Elijah Yeates and his heirs a negroe girl named Violet and her increase and a cart. Item fourth.
