Ora Curtis Poff died on March 25, 1922 at Roanoke, Virginia, at age 37.1,6,3 She Mrs. Ora C. Sowder died from influenza in a local hospital Saturday morning about 12 o'clock. Funeral services were held yesterday afternoon from the home by Rev. P. G. Lester of the Primitive Baptist Church. Internment was in Evergreen Cemetery. Mrs. Sowder was born at Copper Hill, Floyd County, November 6, 1884. She is survived by her husband, Eugene A. Sowder and three sons, Robert, Augustus and Eugene, one daughter, Blanch, of this city. Her parents, Mr. and Mrs. J. J. Poff, of Copper Hill, two brothers, Horace and Byron J. Poff and six sisters, Mrs. Hay Mason, Mrs. John Rumburg, Mrs. Howard Gray, Mrs. W. C. Simpson, Miss Iva Poff and Miss Iris Poff all of Copper Hill. on March 27, 1922.5

Dr. Herman Lee Poff was buried at Gray, Poff, and Kropff Family Cemetery, Rt. 221, across from Simpson's Store, Check, Floyd Co., Virginia.1 He was born on June 23, 1887 at Copper Hill, Floyd Co., Virginia; The Virginia Births and Christenings database has a birth date of Jun 1, 1887 and his death certificate has Jun 21, 1887.1,2,7,3 He married Alma Florence Poff, daughter of William Anthony Lemuel Poff and Cordelia Christine "Della" Wimmer, in December, 1910 at Bristol, Sullivan Co., Tennessee.8 Dr. Herman Lee Poff died on August 7, 1921 at Roanoke, Virginia, at age 34.3 He SAM BARNARD KILLS DR. Check neighborhood was thrown into a high state of excitement Saturday night when it became known that E. S. Barnard, a merchant at that place, had shot and fatally wounded Dr. Herman L. Poff, of Ferrum, in the home of Dr. Poff's father, J. J. Poff, the place where Bernard (sic) was boarding. It seems that the trouble grew out of "a woman in the case," but we were unable to get the full particulars and no one seems to know exactly how it all came about, and probably will not be known until the trial. ______________that he shot Poff in self defense, but from what can be learned, it seems that Barnard _____________ that first shot. Dr. Poff's family were visiting at J. J. Poff's at Check, and it seems that Barnard had been paying some attention to Mrs. Poff, and when Dr. Poff came up Saturday night, and, by having car trouble, did not get to Check until about midnight, he found his wife in Barnard's room, she claiming to be getting some hair tonic. The shooting followed. Poff was shot in the leg and in the head.
After the shooting, the doctors, that had been summoned, advised him to be taken to Roanoke at once. Barnard, having a big car started at once with Dr. Poff to Roanoke but on arrival there it was found that nothing could be done for him and he died Sunday afternoon, and the remains were brought back to Check and buried Monday.
Barnard was arrested Sunday and placed in the Roanoke jail and Sheriff Brammer went to Roanoke and brought him back here Monday and placed him in jail.
It has been sometime since such an exciting tragedy has taken place, in this county, as both men are of prominent families.
Barnard will probably have a preliminary hearing sometime next week. on August 11, 1921.9 He BARNARD WAIVES HEARING
Tuesday was set for the preliminary hearing for E. S. Barnard, who is now in jail here charged with the killing of Dr. Herman L. Poff, of Ferrum, at Check on Saturday night, Aug. 6th. in the home of Poff's father, J. J. Poff. A very large crowd was in town to be present at this hearing, but Barnard waived the hearing, and will go over to the grand jury at the Oct. term of court.
Commonwealth Attorney Pedigo will be assisted by B. G. Howard of this place and H. D. Dillard, of Rocky Mount. The defense will be represented by J. E. Proffit, of the local bar, and Lawson Worrell, of Roanoke.
We stated last week, that from what could be learned that Barnard must have fired the first shot, but now it seems that there is no evidence to that effect and that Barnard's statement might be true, where he claims that he shot in self defense. All kinds of reports are going the rounds---many not correct, while a few might be, yet the people should not express themselves, or criticise either side until the facts are made known.
Many of the good citizens of the county would like for a compromise to be effected in this case, as there are several of our most prominent families connected with the case that do not care to be brought to court in connection with this case. on August 18, 1921.9 He THE BARNARD CASE

Poff, at Check, the 6th day of August, was called in court yesterday morning and was gone into and as we go to press, court is selecting the jury, which will probably be gotten sometime to day. The case has attracted quite a good deal of attention owing to the prominence of both families.
It will be remembered that Dr. Poff was shot and mortally wounded by Barnard, who claims that he shot in self defence, as Poff shot at him at close range first.
The prosecuting attorney, H. S. Pedigo, is being assisted by B. G. Howard, of the local bar, and Dalton Dillard and Herbert Dillard, of Rocky Mount. The defense if being represented by J. E. Proffit, of the local bar, and Lawson Worrell and S. H. Hoge, of Roanoke.
The case will engage the attention of the court all of this week, and probably will run into next week some. on October 20, 1921.9 He BARNARD GIVEN 12 YEARS IN PENITENTIARY
One of the most interesting cases that has been held in court here for a long time, came to a close Monday evening about six thirty o'clok. (sic) The jury's verdict was "we the jury find the defendent guilty of murder in the second degree and place his punishment at twelve years in the penitentiary."
This was the outcome of the trial of E. S. Barnard, of Check and the son of J. C. Barnard, of Roanoke.
He was indicted for the murded (sic) of Dr. Herman L. Poff, of Ferrem, a former Floyd man and son of J. J. Poff, of Check....
The trial began last Wednesday and continued til Monday evening. Both sides had good counsel and the case was closly contested all the way through. One of the largest crowds ever seen here at a trial was present throughout the trial.
After the verdict was rendered, councel for the defense made a motion to set aside the verdict as being contrary to the law and evidence, but the judge overruled the motion, but suspended sentence for 90 days in order for the councel to appeal to the supreme court of Virginia.
Motion was made for bail and the judge fixed the amount of bail at $7,500, and the bond was given Tuesday. J. C. Barnard and R. J. Wright, of Roanoke, are the sureties.
Dr. Herman L. Poff was shot and killed by E. S. Barnard on the 6th of August, Barnard claiming that he shot in self-defence, claiming that Poff was shooting at him.
It appears that Dr. Poff had sent his family to the home of his father, at Check, in whose home Barnard was boarding. A few days later when at 11 o'clock at night. The shooting soon followed. Mrs. Poff claimed that she had gone to the room for an article that had been left in the room during the day.
Several shots were fired, but two took effect, one in the head and the other in the leg of Poff. He was taken to the hospital in Roanoke but died the next evening.
Barnard was arrested Monday brought here and lodged in jail where he remained till the trial was over. on October 27, 1921.9 He BARNARD APPEALS CASE
Richmond, Feb. 8, -- E. S. Barnard, a merchant of Check, Floyd County, has filed an appeal --- from the judgment of the Circuit Court of Floyd County convicting him on a charge of the murder of Dr. Herman Poff and sentenced him to twelve years in the penitentiary.
Barnard is now out on bail in the sum of $7,500. The case will be argued before the Court of Appeals sometime in June. Barnard's bail bond calls for his return here at the April term of court. He will then give bond till he finds out whether the appeal will be granted or not.
Barnard was tried in the Floyd circuit court at the October term. on February 16, 1922.9 He Richmond, 16 Nov. E. S. Barnard, convicted of second degree murder for the killing of Dr. Herman Poff, of Floyd County, was granted a new trial by the State Supreme Court of Appeals today. Barnard, the records of the case state, shot Poff when the latter fired into a room in which he was sleeping, alleging he saw Mrs. Poff come out. Mrs. Poff denied this, testifying she merely pur her arm through the door of the room to replace a brush with which she had been brushing her hair. The case was reversed on the grounds that certain statement [sic] by the doctor after he was shot were not dying declarations.
It will be remembered that at the October term 1921, of our circuit court E. S. Barnard was found guillty of murder in the seond degree and given 12 years in the penitentiary for the killing of Dr. Poff in August, 1921. This was one of the most sensational trials that has been held here since the John Richard's trial several years ago. on November 23, 1922.9 He The E. S. He was a retired supervisor from DuPont after 31 years of service, was a World War II Army veteran and a member of Stout United Methodist Church. He often express compassion for others by cooking for shut-ins, church friends and neighbors. He is survived by his wife of 53 years, Helen Evans Rumburg; his daughter, Kimberli Rumburg Canstantino and two grandsons, Evan and Alexander, all of Parkersburg. He also is survived by two sisters, Jeanette R. Baker of Reynoldsburg, Ohio, and Ruth R. Johnson of South Charleston, W.Va. He was preceded in death by his parents; one sister, Mildred Long and one brother, B.W. Rumburg. Services will be 3 p.m. Sunday at Stout Memorial United Methodist Church with the Rev. Lindsay Thorpe officiating. Burial will follow in Mt. Olivet Cemetery. Family will receive friends at their residence, 3306 Central Ave., Parkersburg, from 4-8 p.m. Saturday and at Stout Memorial from 1-3 p.m. Sunday. Jay was the former recreation director for the city of Nitro for 20 years until retirement in 2000, a former insurance agent for National Life and a former employee of FMC Ordinance Plant. Jay had portrayed Santa Claus for 40-plus years in homes, parades, hospitals and various other venues, and is a member of the Santa Claus Hall of Fame in Santa Claus, Ind. He was a member of the Nitro Lions Club, Great Kanawha RC&D, the Nitro Church of the Nazarene and the Nitro Missions Team. Jay was very proud to be a 1957 graduate of Poca High School. He was preceded in death by his parents, Harold and Mildred Long; sister, Norma; and brothers, Doug and Ted. Jay is survived by his loving wife of 56 years, Viola Cook Long; son, Jeff Long and wife, Aliza; pride and joy of his life, granddaughter, Alyson; sister, Ruth Ellen; brothers; and several cousins, nieces and nephews, church family and a host of friends. A celebration of Jay's life will be held at 11 a.m. Saturday, June 11, at Cooke Funeral Home Chapel, Nitro, with Pastor David Clark officiating. Burial will be in Tyler Mountain Memory Gardens. The family will receive friends from 6 to 8 p.m. Friday, June 10, at the funeral home.
